Right of withdrawal for customers acting as consumers

Consumers have a right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us – Zugo24 GmbH, Oguz Caglayan, Im Morchhof 41, D-68199 Mannheim, e-mail: bestellung@zugoshop.com – of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, although this is not mandatory.

Exclusion of the right of withdrawal for sealed goods

The right of withdrawal does not apply to contracts for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene, if their seal was removed after delivery.

A seal within the meaning of this provision is a clearly visible security feature applied directly to the product itself that cannot be removed without visible traces (e.g. an induction seal under the cap, a sealed spray or pump head, a sealed applicator).

If a product has such a seal and it has been removed or damaged by the consumer, the right of withdrawal for that product is excluded. Whether a product has such a seal is stated in the respective product description.

If a product has no such seal, or the seal has not been removed, the statutory right of withdrawal continues to apply; in that case the following provision on compensation for loss of value applies.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (with the exception of additional costs arising from your choice of a delivery method other than the cheapest standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract.

For this reimbursement we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; you will not be charged any fees for this reimbursement.

We may refuse reimbursement until we have received the goods back, or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

Compensation for loss of value

You only have to pay for any loss in value of the goods where that loss results from handling the goods beyond what is necessary to establish their nature, characteristics and functioning.

This applies in particular to products without a seal in the sense described above: use beyond the handling necessary for inspection (e.g. repeated removal of product, noticeable reduction in quantity) may lead to proportionate compensation, measured by the actual loss in value of the goods.

If the packaging has been damaged or rendered unusable beyond the extent necessary for inspection, so that repackaging in its original condition for the purpose of resale is no longer possible, we are entitled to offset the resulting costs proportionately against the refund amount.

The respective compensation amount is determined in each individual case on the basis of the actual damage incurred and is not a flat fee.
